Terms of engagement
English translation for convenience. The Spanish version prevails.
Last updated: September 2026
These terms apply to the writing services I provide under the trading name Big Words Copywriting (full details in the Legal notice). I also send them with every quote. If anything in the written quote contradicts these terms, the quote wins. "Consumer" means someone who hires me for purposes outside their trade, business or profession. If you hire me as a business or self-employed professional, the clauses marked as consumer-only don’t apply to you.
1. What each job includes
The work is what the written quote describes: type of copy, number of pieces or words, language, deadlines and deliverables. Anything not listed there isn’t included. If you want to add something during the job, I’ll send you a separate quote first.
2. Quote
You’ll get a written quote before I start. It’s valid for 30 days from the date I send it. The job is confirmed once you accept it in writing (an email is fine) and pay the deposit.
The "from" prices on the website are guide prices. The price that counts is the one in the quote.
3. Prices and VAT
- Consumers: the quoted price is final, VAT (IVA) included.
- Businesses and self-employed clients: prices are given before tax. The applicable VAT and, where relevant, Spanish income tax withholding (IRPF) are added and itemised on the invoice.
4. Payment
- 50% when you accept the quote. I start work once it arrives.
- The remaining 50% on delivery of the final copy.
- Payment by bank transfer, within 15 days of the invoice date.
If the final payment is late, I can hold back the transfer of usage rights until it’s paid (clause 8).
5. Monthly package
The Monthly package has a 3-month minimum term. After that it rolls on month to month until either of us cancels in writing with 30 days’ notice. It’s invoiced at the start of each month. If you’re a consumer, the minimum term doesn’t affect your right of withdrawal (clause 14).
6. Revisions
Each delivery includes 2 rounds of revisions. A round is one set of changes sent together, on the same version. Revisions adjust the copy to the agreed brief. If the brief itself changes (different audience, angle or offer), that’s new work and I’ll quote it separately, as with any extra rounds.
7. What I need from you
To do the job well, I need you to:
- send the agreed information, access and materials on time;
- review deliveries and reply within a reasonable time;
- check that any facts about your business in the copy (prices, opening hours, features, terms) are accurate;
- have the right to use the materials you give me (copy, photos, trademarks, third-party data).
If delays come from your side, delivery dates move by the same amount. If a job stalls for more than 60 days because I haven’t heard from you, I may close it and invoice the work done up to that point.
8. Rights to the copy
Once the whole job is paid, I assign you the exploitation rights to the delivered copy (reproduction, distribution, public communication and transformation), exclusively, worldwide and for the full term of protection, for the uses covered by the job, under Articles 43 to 57 of Spain’s Intellectual Property Law (LPI). If the quote limits any use, it says so there.
Drafts and discarded versions are not assigned.
Moral rights (such as the right to be recognised as author) can’t be waived under Spanish law and stay with me. You don’t have to credit me or the brand on the copy.
9. Portfolio
I’ll only show work I did for you on my website or social media if you give me written permission. Without it, I don’t mention it.
10. Confidentiality
I treat any non-public information you give me for the job as confidential: business data, prices, plans, launches. I don’t share it or use it for anything else. This duty continues after the job ends.
11. Use of AI
I may use AI tools for support tasks, such as researching a topic or checking a text. I don’t put your confidential information into public AI tools. Every text I deliver is written and edited by me.
12. Results
I write to help your copy sell, but sales, bookings, Google rankings and conversions depend on plenty I don’t control: your product, pricing, the market, competitors, how and where the copy is published. So I don’t guarantee specific commercial results.
13. Liability
My liability for each job is limited to the amount you’ve paid for it, except in cases of wilful misconduct (dolo) or gross negligence (culpa grave).
If you’re a consumer, this limit doesn’t reduce any rights the law gives you.
14. Right of withdrawal (consumers only)
If you’re a consumer and you hire me at a distance (by email, phone or through the website), you may withdraw from the contract within 14 calendar days of its conclusion, without giving any reason, under Articles 102 to 108 of Spain’s consumer protection law (TRLGDCU).
How to withdraw. Send me a clear statement before the period ends, by email to hola@bigwordscopywriting.com or by post to Carrer Bartomeu Oliver de Can Tunis, 45, 07198 Son Ferriol, Palma (Illes Balears), Spain. You can use the model form below, but you don’t have to. It’s enough to send your notice before the deadline.
Refund. I’ll refund what you’ve paid within 14 days of receiving your notice, using the same payment method unless we agree otherwise, at no cost to you.
If you want me to start before the 14 days are up. By default I don’t start until the period ends. If you want me to start sooner, you have to ask me expressly in writing (Art. 103 TRLGDCU). In that case:
- if you withdraw after I’ve started, you pay for the proportion of the work done up to the moment you tell me, calculated on the total price (Art. 108 TRLGDCU);
- if the service is fully completed within the period, you lose the right of withdrawal, provided you gave your express consent and acknowledged that you knew this.
15. Complaints
Official complaint forms (hojas de reclamaciones) are available to consumers: request them at hola@bigwordscopywriting.com. You can also simply email me with any complaint. I’ll reply and look for a solution.
If you’re a consumer, you can also contact Palma’s municipal consumer information office (OMIC) or the Consumer Arbitration Board of the Balearic Islands (Junta Arbitral de Consumo de las Illes Balears). Consumer arbitration is voluntary for both sides.
16. Governing law and courts
These terms are governed by Spanish law.
- Consumers: the courts where you live have jurisdiction.
- Businesses and self-employed clients: both parties submit to the courts of Palma.
